The Ninth Circuit may perhaps be right that wealthy landowners in Columbia do not constitute a "particular social group" for purposes of asylum -- notwithstanding FARC's severe animosity to them -- because they are not “set-apart, or distinct from other
persons within the society in some significant way.”
But I bet none of the members of the panel would want to be a wealthy landowner in FARC-held territory back in the day.
