People v. Gourley (Cal. App. Div. - July 22, 2011)

Usually when a statute says "shall" it means "must".  As it, you have to do it.  Cases that so hold are legion.

But apparently not in DUI cases.  Where "shall" means "if you feel like it, and if you don't, no biggie."
